a)     The pre-booking is an expression of interest with a refundable advance, not a binding sale agreement.

b)    No specific colour/variant is guaranteed by pre-booking

c)     Selection of colour/variant will only be done post the product launch

d)    Pre-booking does not confer any preferential right to allotment or delivery sequence.

e)     Pre- booking amount is refundable to customers, if they don’t wish to purchase at later stage for any given reason.

f)     Cancellation & Refund Policy

·       Cancellation of pre-booking can be done after the launch of the product.

·       Taxes/fees related to 3rd party payment gateway against the pre-booking amount is not refundable.

·       Refund must be initiated by the customer offline with the dealership with whom the booking was done.

·       Refund will be processed in 10-15 days from date of request by the customer.

·       No interest will be payable on the refundable amount.

g)    All pre-booked customers will receive an exclusive invite for the Virtual launch of the product

h)    100 lucky customers who have pre-booked the product will get a chance to be invited for exclusive Meet & Greet with Yamaha MotoGP riders.

i)      Meet & Greet invite will be open exclusively to resident Indian citizens, excluding residents of the State of Tamil Nadu, pursuant to the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.

j)      Force Majeure. Neither party will be liable for inadequate performance to the extent caused by a condition (for example, natural disaster, act of war or terrorism, riot, labour condition, governmental action, and Internet disturbance) that was beyond the party’s reasonable control.

TERMS & CONDITIONS

These Terms & Conditions are issued by India Yamaha Motor Pvt Ltd (hereinafter referred to as the “Company”) for the purpose of governing the pre-booking of its upcoming vehicle.

  1. Company reserves the right to reject, suspend or cancel any pre-booking in appropriate circumstances, including (without limitation) where incorrect or fraudulent information has been furnished, duplicate or speculative bookings are made, payment is unsuccessful or reversed, or there is any misuse of the booking platform.
  2. All promotional material is illustrative in nature and subject to change.
  3. Pre-booking is made with the Company through its website only, and that the allotment and final sale of the vehicle shall be completed through an authorised dealer. It may also be specified that the customer may be required to execute a separate booking form, order form and other sale documentation at the dealer stage.
  4. Payment of the refundable advance does not lock or guarantee the final ex-showroom price or any applicable taxes, duties or other charges. The vehicle, if purchased, shall be invoiced at the price prevailing on the date of invoicing or as otherwise communicated by the Company.
  5. The pre-booking is personal to the customer and shall not be assigned, transferred or sold to any other person without the prior written consent of the Company.
  6. Only one pre-booking is permitted per individual, PAN, registered mobile number and/or email address
  7. Payments are processed through third-party payment gateways and that the Company shall not be responsible for any delay attributable to banks or payment intermediaries. Refunds shall be processed only to the original source of payment and shall remain subject to the processing timelines of the relevant bank or payment service provider.
  8. This pre-booking and any disputes arising therefrom shall be governed by and construed in accordance with the laws of India. The courts at Chennai shall have exclusive jurisdiction over all matters arising out of or in connection with the pre-booking.
  9. The Company’s liability under or in connection with the pre-booking shall be limited solely to the refund of the booking amount paid by the customer. The Company shall not be liable for any indirect, incidental, consequential, or special damages, including loss of opportunity, goodwill, or anticipated savings.
  10. All refunds shall be limited solely to the booking amount paid by the customer and shall be processed only to the original source of payment used at the time of booking. Refund requests must be submitted in writing to the dealership with proof of booking and valid identification. The Company shall ordinarily process refunds within 10–15 working days of receipt of a valid request; however, the Company shall not be liable for any delays attributable to banks, payment gateways, or other intermediaries. No interest, damages, compensation, or additional claims shall be payable in respect of the refundable amount, and once the refund has been initiated to the original payment source, the Company shall have no further liability.
  11. The Company reserves the right to amend, modify, or update these Terms & Conditions at any time, and such revised terms shall be effective upon publication on the Company’s website. Customers are advised to review the Terms & Conditions periodically.
  12. All communications relating to the pre-booking shall be made through the customer’s registered email address and/or mobile number provided at the time of booking. The Company shall not be responsible for any failure of communication due to incorrect or outdated contact details furnished by the customer.
  13. The Company shall collect, store, and process customer information in accordance with applicable data protection laws. Customer data shall be used solely for the purposes of processing the pre-booking, related communications, and promotional activities, subject to the customer’s consent.
  14. If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  15. Nothing in these Terms & Conditions shall limit or exclude any rights of the customer under applicable consumer protection laws. These Terms & Conditions are subject to all mandatory provisions of law in force at the relevant time.
  16. These Terms & Conditions constitute the entire agreement between the customer and the Company in relation to the pre-booking and supersede all prior communications, representations, or understandings, whether oral or written.
  17. Failure or delay by the Company in exercising any right, power, or remedy under these Terms & Conditions shall not constitute a waiver of that right, power, or remedy.
  18. The customer agrees to indemnify and hold harmless the Company, its affiliates, officers, and employees from any claims, damages, liabilities, costs, or expenses arising out of misuse of the booking platform or breach of these Terms & Conditions.
  19. The Company may assign or transfer its rights and obligations under these Terms & Conditions to any affiliate or successor entity without requiring prior consent of the customer.
